During 2014, the legal environment surrounding privacy and BYOD changed dramatically. The U.S. Supreme Court unanimously held that the searching of smartphones should be treated in the same way as searching someone’s home: that is, requiring a court order. Separately, in California, it was ruled that non-exempt workers are entitled to overtime pay whenever they answer an email outside of normal hours.
